Linking

From time to time, the Black Tusk Gallery (“Black Tusk”) may decide to link to websites that it determines may be of interest to visitors to Black Tusk’s website (the “Site”). These websites may offer educational, governmental or other resources or may be owned or controlled by advertisers, sponsors, licensees, customers, consultants or other third parties.

Black Tusk is not responsible for the contents of any linked site, any link(s) contained in any linked site, or any changes or updates to the information contained in such sites. Black Tusk provides links to third party sites only as a convenience and the inclusion of any such link on the Site does not imply Black Tusk’s endorsement of either the site, the organization operating such site, or any products or services of that organization.

A visit to any site or page from Black Tusk’s website via any such link is done entirely at your own risk. We strongly recommend reading the Standard Terms and Conditions, Privacy Policy, Disclaimers or other notifications that may be found on any such third party websites. Under no circumstances will Black Tusk be held responsible or liable, directly or indirectly, for any loss or damage that is caused or alleged to have been caused in connection with the use of, or reliance on, any content, goods or services available on any other site.

Should any link on Black Tusk’s website or any linked website be found objectionable for any reason, a request that the link be removed from Black Tusk’s website should be sent to info@blacktusk.ca. Black Tusk will consider all such requests but shall have no obligation to remove any links or respond.

Would Black Tusk link to my website?

If you would like Black Tusk to link to your website, send a request to info@blacktusk.ca. Please include your name, your organization name, contact information (such as a phone number and/or e-mail address) as well as the URL of your site and a list of any URLs from which Black Tusk may link to. All requests will be decided on a case-by-case basis in the sole discretion of Black Tusk and all decisions shall be final. Black Tusk will use reasonable efforts to contact you upon deciding to link to your website, but failure to do so will not result in any liability or other obligation to you. Black Tusk has no obligation to notify you of any negative decision. It is generally the policy of Black Tusk to give preference to link to educational and governmental resource materials.

May I link to Black Tusk’s website?

Black Tusk permits third party sites to link to Black Tusk’s website located at www.blacktusk.ca pursuant to the terms below.

If you are interested in linking to Black Tusk’s website, you must notify Black Tusk by sending an e-mail to info@blacktusk.ca. Please include your name, your organization name, contact information (such as a phone number and/or e-mail address) as well as the URL of your site and a list of any URLs from which you intend to link to Black Tusk’s website

By linking to any page on Black Tusk’s website, you hereby agree to be bound by the terms and conditions as set forth below:

  • Links may be text-based using the words: “Black Tusk Gallery,” “Black Tusk” or ” info@blacktusk.ca ” (the “Licensed Marks”). You may not use the Black Tusk logo or any other trademark as a link to Black Tusk.
  • By linking, you acknowledge and agree that, other than as set forth herein, all rights to the Licensed Marks, other Black Tusk marks, the content appearing on the Black Tusk website and the design of the Black Tusk website belong to Black Tusk.
  • You may not create frames around Black Tusk’s web pages or use other techniques that alter in any way the visual presentation or appearance of Black Tusk’s website.
  • You must not misrepresent your relationship with Black Tusk or present false or misleading impressions about Black Tusk. No links to Black Tusk’s website may be used in a manner that implies or suggests that Black Tusk approves or endorses you, your website or your goods and services (in all cases, except as Black Tusk may have agreed separately with you in writing).
  • Black Tusk shall have no responsibility or liability for any content appearing on your website. You agree to indemnify and defend Black Tusk against all claims arising out of or based upon your website.
  • No link(s) may appear on any page on your website or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.
  • Black Tusk reserves the right at any time and in its sole discretion to request that you remove all links or any particular link to Black Tusk’s website from your site.

Subject to your compliance with the above terms, Black Tusk agrees to grant you a limited, non-exclusive, non-transferable, royalty-free license to use the Licensed Marks solely for the purpose of establishing any permitted link hereunder. Except for the limited license to use the Licensed Marks set forth in this paragraph and otherwise as may be permitted by applicable law, you may not use any of Black Tusk’s trademarks or service marks for any other reason without the express written permission of Black Tusk. Black Tusk may at any time, in its sole discretion, without cause, terminate the license granted herein to use the Licensed Marks and your right to link to any pages on the Black Tusk website. In such event upon request, you agree to immediately remove all links to Black Tusk’s website and to cease using the Licensed Marks. Thereafter, any future links to Black Tusk’s website will require the express written permission of Black Tus. Black Tusk reserves the right to amend these linking terms and conditions at any time. By continuing to link to the Black Tusk website, you agree to be bound to and abide by these linking terms and conditions, as well as other legal terms of use and conditions on the Black Tusk website, as amended from time to time. All terms and conditions related to the use of Black Tusk’s website will be construed according to the laws of British Columbia, Canada, without regard to its conflict of law provisions.
